to be in the moment, though. here's what we know about the suspect, 24-year-old james holmes. investigators say holmes is not cooperating with their questions and said nothing this morning during his court appearance. police searched his apartment this weekend and found several batman-related items including a poster for the new movie and a batman mask. fox's craig boswell has the latest from the courthouse in colorado. >> reporter: it's the first public glimpse of james holmes since he allegedly walked into the movie theater and opened fire. james holmes sat silent with a blank stare, the once promising former grad student was wearing a jailhouse jump suit with his hands shackled. as the judge spoke, 24-year-old seemed uninvolved. the purpose of the hearing was to inform holmes of the charges he'll soon face. when he was offered a chance to speak? >> do you have any questions? >> reporter: he stayed quiet. at one point he closed his eyes. prosecutors are expected to file charges formally next monday. a mental health evaluation is routine in cases like this. >> i would say there's no such thing as

midnight movie massacre. here's what we know about james holmes, the suspected gunman. investigators say he bought four guns and 6,000 rounds of ammunition legally on the internet and in local stores. he used at least three weapons opening fire on unsuspecting victims killing 12, a total of 70 people hurt. tonight 11 people are in critical condition. officials have not yet released their names. in moments we will be joined live by a teenager who survived who was inside the theater when the shooting began, but first let's get the latest from fox 5's bob barnard. >> it's only been in the last hour or so the bodies of the 10 victims who died inside the theater have been removed. aurora police getting ready to meet with families to confirm identifications. 30 victims remain hospitalized tonight. >> 315 entry 14 for a shooting at century shooter 14300 east alameda avenue. they're saying somebody is shooting in the auditorium. >> moviegoers captured these images of the chaotic scene right after the shooting. >> everyone is screaming and crying around there. >> police and fire dispatchers quickly
